The University of Nairobi (UoN) has escalated its ongoing governance dispute to the Supreme Court, seeking arbitration in a conflict that has resulted in at least 16 court cases. The dispute, primarily between the university’s council and management, has raised concerns over leadership, recruitment processes, and financial stability at Kenya’s top higher education institution.
During a recent visit, the National Assembly Education Committee expressed shock at the extent of the crisis, noting that governance reforms had created a toxic environment within the institution. Acting Vice-Chancellor Prof. Margaret Jesang highlighted the strained relationship within the management, citing the recent suspension of Dr. Maloba Wekesa, a senior lecturer and the University Academic Staff Union’s (UoN Chapter) Secretary, as an example of internal discord.
Members of Parliament pointed out that there had been a failure to adhere to established rules and regulations in the recruitment of staff, particularly in newly created positions. This has exacerbated tensions between different factions within the university leadership.
The governance crisis has also triggered financial concerns, with mounting legal fees from the 16 court cases potentially worsening the university’s already dire financial situation. The institution has been struggling with financial constraints, and there is growing worry that these legal battles could divert critical resources away from academic and infrastructural needs.
Additionally, the university has appealed to Parliament for assistance in clearing outstanding statutory obligations amounting to Ksh 7.7 billion. The financial burden threatens to cripple the university’s operations, potentially affecting students, faculty, and ongoing projects.
With the matter now before the Supreme Court, stakeholders hope for a resolution that will restore stability to Kenya’s premier institution of higher learning.
